Email from the vp after I put a period on the issue at a meeting.

Like I resubmitted a request, email was ignored for 30 days, and according to restrictions that's automatic approval, case closed, not going to sue myself, etc.

Morning, I need to see your ORIGINAL request to build with specs that showed the RED door included and the approval of those specs. If the red door was included and the board approved those specs, These documents should clearly show that the board was negligent in demanding you change the color of your door AFTER they originally approved it.

This entire issue is unfortunate but as a gate keeper of this community, I need to be able to DEFEND the reversal of your door back to red to the community .

I have thoroughly read the restrictions, including article III.3.5 At this point, i have no other prior tangible evidence or history of this issue aside from that and your verbal account of what has transpired.

Additionally, I don’t believe it was appropriate for you to JUST tell the board what YOU were going to do within 3 DAYS from your announcement. You even admitted this was an issue you wanted to bring up at our last meeting, but didn’t. It would have given the new board a lot more time to be brought up to speed and examine the documents to support you.

It would have been much more palatable
if you had presented ALL of your evidence to the new board to help us understand what had transpired and if, indeed, the previous board was negligent in demanding you change the color of your red door in the first place. I believe this approach would have been clearly viewed as a good faith effort on your part to be as transparent as possible. LET ME BE CLEAR. This e-mail is not meant to challenge your honesty. We need documentation to support it.

THEREFORE This e-mail will serve as a document request for the following:

Home Building specs submitted to the board that show the red door.
Returned specs or documents from the board showing the APPROVAL.

Submitted the above documents to the board by APRIL 29 and DELAY painting your door until these documents can be reviewed. You should have these documents therefore the review would only take a day.

Just as our community should be held accountable, the board should be held accountable as well.

I am deeply sorry you and your family have had to go through this. However, I am convinced we all want to do the right thing.

I want to know why old prez and original pres, your Architechtural Committee, was not part of the decision with regard to the painting of the red door which is not in the neighborhood color pallet the original board agreed to. These decisions are made by the architectural committee and the board collectively.

1. I submitted the request on Feb 19 and it was not responded to in the requisite 30 days. Per section 3.5 of the restrictions, this is automatically approved.
2. The neighborhood in fact does not have an official color pallet.
3. As the Bylaws we are drafting state, the comitiites only make recommendations that are not binding. The board of directors makes the ultimate decision.

This is my final word on the matter. We have other issues to attend to and need to focus efforts accordingly.
