It's not in CA and in a number of other states, but yea...if you're rolling markup or negative equity, GAP is mandatory.

How is "mark up" part of that... that's a fictitious figure created by the if he crashes it out of the gate.... 47k balance due on a 42k msrp car that has already depreciated... 5k... so that's at least a 10k gap, how high up does the gap insurance go ?
Also how on earth would this mark up go to the I am confused... VW-US would "own" the vehicle... and the 5k latched on is not part of their pricing structure they can pocket

It's included in the total amount of the note. Vehicles on dealer lots are owned by the dealer, not the OEM. So when a vehicle is leased, the bank (or OEM) effectively buys the car from the dealer. MSRP is only relevant when it comes to the residual calc, but the selling price can be anything. With the residual set, the more the car "sells" for, the more the bank makes in interest, so they don't care within reason.
